Normally I'd expect that a person in your position might have just gotten bored and wandered off (or maybe even just outright cowered with realization). But, in your case, it seems possible that you might actually still be continuing this conversation - just that you're trying to do it telepathically or by gesticulation. Let me admit that I'm not good at charades, and that I'm wearing too much tinfoil, so you should just use the keyboard instead. It's the flat thing with the letters on it.

Still a stupid law. Where you think you are aiming, where you are aiming and where the bullet ends up are often three different places. Funny, the areas with the most experience with firearms seem least able to understand ballistics.
That and nearly anyone is worth more than a case of beer. Especially American beer.

Oh well, if requiring some kind of mental state for a murder conviction is stupid, every jurisdiction I know is stupid. Let's just change it to strict liability for killing people. So much easier.

It's been said enough times already but let's say it again anyway: the crime of manslaughter exists precisely to deal with situations where someone's actions are culpable without having the mental state needed for murder. If a prosecutor ignores this possibility in a case that doesn't make the general law foolish, it makes the prosecutor foolish.

I think the prosecutor overstepped in this case. Given the law and the location, I am not certain why he proceeded as he did.
It is the law which states it is permissible "to use deadly force to recover property during a nighttime theft," to which my statement applies. This is barbaric.

The flat things round here with letters on are all books. My keyboard is one of the old fashioned bumpy sort, with all sorts of non-flat features. Still, you keep gumming away for the delight of the masses.

Back to the OP, could the defendant be charged with some other crime at this point? Not manslaughter I would imagine (would this be covered under the 'you can't be tried for the same crime twice' concept?) but negligent discharge of a firearm or something?

Depends on how accurate you and your gun are. This guy used an AK-47. In that case the best strategy to kill someone is to spray bullets randomly in that person's general direction. Which is what he did.
